Delivering Aid “increasingly dangerous” in Central African Republic
Militias disrupting aid, “hurting their own communities,” says IRC’s president, David Miliband
Delivering aid in Central African Republic has become increasingly dangerous due to escalating violence, the International Rescue Committee said today. Armed groups are attacking civilians with impunity, and even aid workers have become targets, with aid agencies forced to cut back services.
“Tens of thousands of displaced people are not receiving the lifesaving care they need,” said Maggie Fleming, the IRC’s Country Director in Central African Republic. “As a result of the violence in Bangui last week, we have had to suspend our programs for seven of the last 10 days in the city. Many locations providing sanctuary have been attacked. The security situation is extremely fluid and while our teams continue to try and reach the people in need, carrying out our activities in this kind of environment is becoming increasingly dangerous.”
“Across the country the situation is just as bad and aid agencies are being seen as targets,” Fleming continued. “The IRC’s field office in Kaga Bandoro in the north of the country was robbed three times in the last six weeks.”
Earlier this week aid workers from a sister agency were stopped at a checkpoint outside the town of Bocaranga and their lives were threatened. In late April, aid workers were killed.
“What is most appalling is that by attacking aid workers these militias are hurting their own communities,” said the IRC’s president, David Miliband. “We can’t assist if we can’t travel and work safely. What these groups are doing is not only against international law that protects humanitarians but is incredibly self-destructive. Those involved in the conflict in the Central African Republic must let us do our work unhindered.”…

International Covenant on Civil and Political Rights should include stronger provisions for torture survivors

The IRCT and other civil society organisations have recommended amendments to General Comment No. 35 on Article 9 of the International Covenant on Civil and Political Rights (ICCPR). Article 9 enshrines rights to liberty and freedom from arbitrary detention.

One particular area of concern for the IRCT and its partners is the connection between Article 9 of the Covenant and Article 7, which prohibits the use of torture. In the submission to the UN it is noted that while the focus on state provided legal safeguards is welcome, the importance of providing these to prevent the often inevitable consequence of torture while in detention is not strong enough.

“We urge the Committee to include a separate detailed stand-alone paragraph or paragraphs on safeguards [and] considering their very close links, this same paragraph should also refer to the importance of such safeguards for upholding the prohibition of torture and ill-treatment,” the group notes.

The IRCT and its partners also call for two additional safeguards to be added to the document, noting that while General Comment No. 35 highlights the importance of allowing for prompt and regular access to independent medical and legal professionals, there should be direct reference to the contact to a relative or third party to inform them about any arrest, and the importance of the right to consular assistance.
It is the view of the group that “without this safeguard, other safeguards, including obtaining access to an independent lawyer and doctor, may be illusory.”

The comments on the Covenant also address life imprisonment sentences, conditions of detention, and the detention of vulnerable prisoners including torture survivors – detention which can have “widespread and seriously damaging effects on the mental (and sometimes physical) health of those incarcerated.”

UNHCR Clarification on Guardian Article
In an article entitled ‘Europe faces ‘colossal humanitarian catastrophe’ of refugees dying at sea’ published on 2 June by The Guardian, UNHCR is paraphrased as saying the UN is considering Africa holding centres for asylum-seekers trying to reach Europe using irregular sea crossings. UNHCR wishes to make the following points by way of clarification:
:: UNHCR is not considering “holding centres” as an alternative to address the challenges of refugees and migrants risking their lives at sea.
:: UNHCR strongly believes that every life counts and we are working in close cooperation with other relevant stakeholders to prevent the alarming loss of life at sea and indifference to people desperately needing protection, including finding alternatives to dangerous journeys, such as resettlement, humanitarian admission and family reunification programmes.
:: UNHCR is calling for urgent, concerted action by coastal and non-coastal states to improve search and rescue at sea, ease disembarkation, ensure protection for refugees, asylum-seekers and the stateless, and halt harmful measures such as pushbacks and detention.
Asylum seekers should have their claims for asylum processed in a secure environment with adequate procedural safeguards in line with international refugee and human rights law.
